Step 1 for your wedding after a divorce: file the lawsuit

The first thing you must do is to file for divorce. This step is crucial because, legally, your marital status remains married until the divorce decree is issued. How long can this whole process take? Well, from the time you file the lawsuit until it is finalized, it can take between 4 months and a year, depending on whether the divorce is amicable or not.

Remember that the Civil Code establishes that you must wait three months from the date of the marriage before filing for divorce. Once the judgment is issued, you will be officially divorced and ready to start the paperwork for your next wedding!

Our advice is not to delay this step. Sometimes couples decide to separate but don’t get divorced right away, and years later find out that their marriage has not yet been dissolved. Don’t wait until it’s time to get married to rush through the paperwork! It is best to do the paperwork as soon as possible and be single for all legal purposes.

It is important to keep in mind that if there are no minor children involved, the divorce by mutual agreement can be done before a notary, which makes the whole process much faster and simpler than the judicial process.

And, what documentation is necessary to manage a divorce?

In order to be able to request the divorce, the necessary documentation to initiate the divorce proceedings is the following:

  • Literal certificate of marriage
  • Certificate of birth of the children (if any).
  • Certificate of census registration (not always requested).
  • Deeds of the movable and immovable properties of the marriage.
  • Payrolls and bank certificates in which mortgages, etc. appear.

Step 2 for your wedding after a divorce: register it in the registry office

Once the divorce decree has been issued, the process is not over yet! Remember that this judgment is not registered in the registry until it is final. What does this mean? Well, there are still some steps to follow before everything is officially in order.

After the sentence, and if there are no challenges or complications, we have to wait about 15 working days for the divorce to be legally formalized. And once this deadline has been met, it is time to go to the Civil Registry.

Why? Because registering the divorce at the Civil Registry is the official way of recording that the marriage has been dissolved. It is like closing that chapter of our life forever! Only after this procedure, both parties can officially consider themselves divorced.

Step 3 for your post-divorce wedding: wait

We’re in the home stretch! But before we can take the next step, we must keep in mind that the registration of the divorce may take a while, especially if the Registry has a large number of applications in queue! So, patience.

Between the time when the divorce decree is issued and the time when a person’s marital status is legally changed, between 30 and 60 days may pass.

But don’t worry, once that time frame has passed, you will finally be able to take the long-awaited and desired step 4.

Step 4 for your wedding after a divorce: you can now remarry

Once steps 1, 2 and 3 have been completed, either of the former spouses can remarry as soon as they obtain the literal marriage certificate with the divorce noted. 

Note that if one or both of the parties have been married before, a copy of the previous marriage certificate must be provided with the Registry annotation stating that the marriage is legally dissolved.

By the way, if you were married in church the first time, the second marriage must be a civil marriage. To remarry in church, you would need an annulment of the previous marriage, which can only be granted by an ecclesiastical court after a judicial process.
